TERMS AND CONDITIONS

Applicability: These Terms and Conditions apply to all contractual and other relationships between YYZ Travel Services (Int’l) Inc. (“Canadian Gateway”) and each passenger or potential passenger with whom it deals, directly or indirectly. They also refer to the contractual or other relationships between the Suppliers (as defined below) and such passengers. Each person who purports to act for any other potential passenger confirms that he or she has the authority to represent, and to bind, that other person.
Canadian Gateway reserves the right to alter these Terms and Conditions at any time without notice, by posting a revised version on its website www.canadiangateway.com. It is the responsibility of the passenger to check at that site to determine if changes have been made.
Tour prices: Tour prices are quoted in US dollars and are based on rates known at the time of pricing. Unless specifically included, all such amounts are subject to GST/HST, as may be applicable. All prices are subject to availability until booked and confirmed. Prices are subject to change without notice due to any number of reasons, including but not limited to currency fluctuations, government action or amendments to itineraries and train timetables beyond the control of Canadian Gateway. An accurate price will be confirmed in writing at the time of reservation. In case of billing errors, Canadian Gateway reserves the right to re-invoice with correct pricing. Brochure prices do not apply to dates of Trade Shows and other International events to be held at destination city.
Not included in tour prices: Unless specifically included, a service or feature shall be deemed to be excluded from any purchase; for example, applicable airport taxes and surcharges, value-added taxes such as GST and HST, visa and registration fees, items of personal nature, laundry, meals not clearly listed as being included, alcohol, tips, telephone calls, gratuities, insurance, excess luggage, other items not listed expressly as an included feature.
Standards: Ontario legislation obliges tour operators to caution passengers traveling abroad that there may be different living standards and conditions at destination with respect to the provision of accommodation, service and utilities outside of Canada. Hotel ratings in this brochure refer to local classifications. They may differ from North American standards.
To avoid any disappointment, we would like to inform our clients that, unlike cruises in the Caribbean, where luxury services and accommodation are frequent, cruises in Russia should be regarded as the most pleasant and convenient way to visit many cities. In no cases can the ships used be compared with those used in the Caribbean in terms of tonnage, size and number of cabins, service and entertainment on board, etc. Criteria used for ship classification are established on the basis of local standards, which may be lower than North American standards. Moreover, these cruise ship companies use different types of ships to operate cruises. The choice of ship is their sole responsibility and is done only a few days before departure, without any consultation with us. In the event that the tonnage of your cruise ship is lower than the one indicated in this brochure, no price change can be made to the cost of tour.
Insurance: We highly recommend that all passengers purchase travel insurance at the time of booking. Canadian Gateway does not accept responsibility for pre-existing or new health problems, unforeseen circumstances, missed or delayed flights, improper or incomplete travel documentation including visas and passports, or damaged or lost luggage. Certain services sold by Canadian Gateway are subject to age and health conditions. Please refer to the website or other information resources of the Supplier(s) of the Service(s) being booked, for details of eligibility and health policies.
* Mandatory insurance is required for the Golden Eagle train trips and all extreme (MiG flights etc) and/or general adventure trips. Speak with your travel agent or Canadian Gateway staff for details.
Some Canadian Gateway trips involve a degree of physical activity and exertion. It is the passenger’s responsibility to ensure they are fit and healthy enough to undertake such physical activity.
Documentation: A valid passport and visa is required for most destinations. It is solely your responsibility to ensure that you are in possession of the necessary documentation to comply with the current and applicable laws and regulations of the country (-ies) to be visited, and with respect to your return to the country of origin. Failure to provide valid documentation may result in denied boarding of the aircraft and cancellation of your travel arrangements without refund. Some countries require that the passport be valid at least six months after the conclusion of your trip. Canadian Gateway may assist you in obtaining the required entry tourist visa.
Canadian Gateway is not responsible for any costs incurred by a passenger who is prohibited from entering a country scheduled to be visited on a trip, or a country to which a passenger may be diverted.
Baggage: Canadian Gateway strongly recommends that you consult the air carrier/or your travel agent as size and weight limitations vary from airline to airline, and destination by destination.
Some airlines are now charging for luggage; please consult your carrier or travel agent.
Responsibility of Canadian Gateway and Others: Canadian Gateway makes arrangements with reputable suppliers (the “Suppliers”) who provide travel and other services (the “Services”).
Canadian Gateway only acts as an agent for the Suppliers in the arrangement of the Services. Canadian Gateway cannot exercise control over the personnel, equipment, operations or goods of the Suppliers, and neither it nor its employees, contractors, officers, directors, agents or other representatives (cumulatively, the “Beneficiaries”) shall be responsible for the acts of omissions of the Suppliers or those for whom they are in law responsible. The Services provided are subject to specific terms and conditions of these Suppliers and limited by their own rates and agreements or by customs or practices of their business. Passengers ought to refer to the website or other information resources of the Supplier(s) of the Services being purchased. Without limiting the generality of the foregoing, neither Canadian Gateway nor the Beneficiaries shall be responsible for claims, losses, damages, costs or expenses arising directly or indirectly from:
-the acts or omission of any party (-ies) other than Canadian Gateway or its employees or others.
-failure by passengers to have proper and valid documentation.
-aircraft delays, Government actions, act(s) of God or any factor beyond the direct control of Canadian Gateway.
-cancellation or delay to any tour or change of itinerary. In case of tour cancellation, liability is limited to the refund of all monies received by Canadian Gateway.
-printing or typographical errors, or errors arising from unforeseen circumstances.
Canadian Gateway reserves the right to decline any passenger as a member of these tours at any time.
Form of payment: Subject to the applicable Cancellation Policies (below), a non refundable deposit for each passenger is payable to Canadian Gateway at the time of booking, to help to secure a reservation. Generally, each passenger must pay to Canadian Gateway a non-refundable deposit per chart below.

Any possible exception will be specified at the time of booking and on the invoice. Payment of the deposit means you have read and accepted these Terms and Conditions. Payment of the deposit does not oblige Canadian Gateway to accept a booking; it is confirmed only upon written notification to the passenger by Canadian Gateway.
Cancellation: To be effective, any cancellation must be in writing and received by Canadian Gateway. The date of such receipt will govern the amount of the cancellation penalty.
General Cancellation policy:
* Less than 45 days before departure – 100% of the total cost of the trip
* Cancellation 75 days or more before embarkation – 15% of cruise price
* 74-70 days before embarkation – 25% of cruise price
* 69-60 days before embarkation – 50% of cruise price
* 59-41 days before embarkation – 75% of cruise price
* Less than 41 days before embarkation – 100% of cruise price
Rail Journeys by Private Train
* 91+ days of tour departure date – Loss of deposit paid or due
* Within 90 days of tour departure date – 100% of the total cost of the trip
All of the above cancellation penalties may change at any time and are confirmed at time of booking.
Itinerary change: Canadian Gateway reserves the right to amend any tour itinerary due to force majeure, change in local conditions, or any other reason that Canadian Gateway may determine.
Although every effort will be made to keep itineraries and hotels as they are shown in the brochure, the Suppliers and Canadian Gateway each reserve the right to substitute itineraries, features, hotels and other Suppliers due to conditions beyond their control. If a change occurs, every effort will be made to ensure that the locations visited, the excursions taken and the hotels offered are similar to the ones originally planned. Subject to any applicable legislation, any change to itineraries will not result in eligibility for a refund.
Cancellation of Services:
Canadian Gateway reserves the right to cancel a tour if not enough participants are registered. In the event that certain services are cancelled, Canadian Gateway will have no responsibility beyond the refund of all monies received by Canadian Gateway for such cancelled services.
Hotels: Rooms with private facilities in Standard class hotels – unless stated otherwise in writing by Canadian Gateway, which reserves the right to substitute hotels for a similar category, should this become necessary due to circumstances beyond its control. Hotel reservations of less than 3 nights may be subject to a booking fee, the amount of which will be confirmed at or before the time of booking. Terms and conditions for hotel reservations will be specified on the invoice for each file. Hotel rooms are not guaranteed before 3 pm check in time. Check out time is 12 noon. Hotels reserve the right to increase rates for special international events and trade shows/conferences.
Accommodation on train: Advance reservations for trains are strongly recommended. Reservations for Trans-Siberian itineraries should be made no later than 45 days prior to departure. 1st class train service is defined as accommodation for 2 persons traveling together in one compartment.
2nd class train service is defined as accommodation for 4 persons traveling in one compartment. Train reservations are totally non-refundable and require passport information at the time of booking.
Private Trains: It is a condition of your booking that each passenger has current and valid Travel Insurance as notified at the time of booking. Canadian Gateway reserves the right to decline to accept a booking if adequate proof of such current and valid Travel Insurance (at its sole discretion) is not provided upon request.
Credit cards: The authorization to Canadian Gateway and/or to a travel agent to use a credit card number for deposit and/or final payment indicates complete understanding of and compliance with all Terms & Conditions, whether or not the appropriate forms/documents have been signed. Verbal authorization of credit card use can be relied upon by Canadian Gateway. A letter of confirmation signed by a credit card holder must be kept on file by the travel agency authorizing the use of the credit card without a signature. In the event that a cardholder refuses to honor a charge, the travel agency may be held responsible. A client paying for the trip with the credit card of the third party must provide written confirmation of the cardholder’s consent. Credit card payments are subject to a 3 – 3.5 % fee.
Refunds and claims: Subject to any applicable legislation, there is no refund for unused transportation or land portion including voluntary modifications made by the tour participant, or if portions of tour area are missed. In the event that certain services are canceled, the tour operator will have no responsibility beyond the refund of all monies received by Canadian Gateway or the Supplier in relation to that service, which refund will be deemed to constitute full settlement. Changes to flight itineraries, name and date changes may result in penalties charged by the airline or ground supplier concerned, and passed on to the passenger. The passenger agrees that any claims shall be made by the tour participant in writing, and received by Canadian Gateway within fifteen (15) days of the return to the point of origin of such passenger.
Special requests: Unless confirmed in writing, special requests — such as room location, bed types, special meals etc. – cannot be guaranteed by Canadian Gateway. Passengers must advise Canadian Gateway and/or the relevant Supplier in writing of all relevant allergies or other dietary restrictions, or mobility issues. Canadian Gateway may be able to assist, if advised in a timely manner. There may be additional costs associated with the accommodation of these requests.
Photographs and other depictions, in any brochure or other promotional piece, of destinations, hotels and other elements of the Services may not be actual or currently accurate representations of the Services being purchased.
Legal: Each tour participant agrees that any dispute regarding the Services or these Terms & Conditions shall be governed by the laws of the Province of Ontario, and the laws of Canada applicable therein. Each tour participant attorns to the jurisdiction of the Courts of Ontario.
Severability: Any determination that any portion of these Terms and Conditions is unenforceable or invalid shall not affect the validity and enforceability of any of the remaining provisions.
Class Action Waiver: By making a Canadian Gateway booking, each passenger expressly waives any right to commence or to participate in any class action against or involving Canadian Gateway, and each passenger expressly agrees to opt out of any class action that may be commenced by another person.
Acknowledgment: The passenger hereby acknowledges having read and understood these Terms and Conditions (as may be modified as set forth above) which shall govern the relationships referred to herein.
